User Terms and Privacy Statement for myBuick Home-to-Vehicle Feature

Thank you for downloading the myBuick home-to-vehicle feature (the “Feature”) to use in connection with your voice-enabled device (“Device”) and your OnStar-equipped eligible vehicle (your “Vehicle”). The Feature is provided by General Motors Holdings LLC (when used in the United States) or General Motors of Canada Company (when used in Canada) and their respective affiliates (“GM” or “we” or “us”) and makes services available to you via your Device. The Feature will not be available if your Vehicle is not connected to our systems via one of our connected vehicle service plans, and may not be available for your Vehicle unless you are participating in a paid service plan for that Vehicle. When you use or access the Feature, you agree to the following (these “Terms”):
- These Terms incorporate the User Terms for Connected Vehicle Services located at www.onstar.com/terms (when used in the United States) or https://www.onstar.com/ca/en/user_terms/ (when used in Canada) (the “Connected Vehicle Service Terms”) and the OnStar Privacy Statement located at www.onstar.com/privacy (when used in the United States) or https://www.onstar.com/ca/en/privacy_statement/ (when used in Canada) (the “Privacy Statement”). Together, these Terms, including the Connected Vehicle Service Terms and the Privacy Statement, are binding between you and us and govern your access and use of the Feature. For this purpose, the term “Services” of the Connected Vehicle Service Terms includes the Feature, “Connected Device” includes your Device, “Agreement” includes these Terms, and “Software” includes the Feature. You should carefully review the Connected Vehicle Service Terms and the Privacy Statement before accessing or using the Feature;
- It is your responsibility to ensure that all users of your Vehicle know that anyone with access to the Feature through your Device may be able to initiate commands to your Vehicle or access information about your Vehicle;
- We are not responsible for the acts of third parties who may access the Feature and information through your Device. You will be mindful of how loud and in front of whom you utter any sensitive information, including your PIN;
- You will be aware of your surroundings and only use the Feature when it is safe to do so, in compliance with the law and these Terms;
- The Feature is provided to you “as is”, and we make no representations or warranties or conditions, express or implied, about the Feature or its availability, and we are not liable for any lack of availability of the Feature;
- GM grants you a non-commercial, non-exclusive, non-transferable, limited, terminable license to use the Feature solely with your Device, throughout the United States or Canada (as applicable), subject to your compliance with these Terms. The Feature is licensed, not sold, to you, solely for your personal use. As between you and us, GM retains all right, title, and interest in and to the Feature and all related data and information, including intellectual property and proprietary rights and interests;
- In the event of any conflict between these Terms and the Connected Vehicle Service Terms or the Privacy Statement, these Terms will govern for any access or use of the Feature. The reference to “Connected Device” in Section 15.2 and in the last subsection of Section 18 of the Connected Vehicle Service Terms does not apply to your Device;
- By linking your GM account with your Device and using the Feature’s features, certain information of yours may be accessible to the Device provider and its affiliates (the “Device Provider”). You understand and agree that the Device Provider’s use of this information is subject to its terms of use and privacy statement.
