User Terms for Energy Pass 

Energy Pass Terms 

Effective Date: 06/04/2026

   These Energy Pass Terms (the “Energy Pass Terms”) govern your use of the charging services available through the Application (“Energy Pass”), which includes the ability to charge your Vehicle at public charging stations participating in Energy Pass (“Supported Networks”) and pay for those charging sessions with a payment method you have on file in the Application. Energy Pass is an Application Service. As such, these Energy Pass Terms incorporate by reference the User Terms for Application Services

and the User Terms for Connected Vehicle Services(https://www.onstar.com/legal/user-term) (each of which are available at onstar.com/legal), (collectively, the “User Terms”). Together, these Energy Pass Terms and the User Terms are binding between you and us and govern your access and use of Energy Pass. In the event of a conflict between these Energy Pass Terms and the User Terms, the Energy Pass Terms will control. Capitalized terms used but not defined in these Energy Pass Terms have the meanings set forth in the User Terms.

 

   Users must comply with all Supported Network policies when charging at that Support Network’s charging station; for example, you must comply with Tesla’s station and charger policies (available at  https://www.tesla.com/legal/terms) when using Tesla-owned charging stations.

 

   We may modify any part of the Energy Pass Terms at any time by giving you notice or by posting an updated version of these Energy Pass Terms through the Application. Your continued use of Energy Pass after any modification of the Energy Pass Terms represents your agreement to be bound by the Energy Pass Terms, as updated.

 

 

Your OnStar Subscription and Energy Pass Payment Methods 

 

  • To use Energy Pass, you must maintain at least one valid payment method on file in the Application and designate that payment method as your payment method of choice for use with Energy Pass.
  • The payment method you select to use with Energy Pass must be the same as the payment method you use to pay for any OnStar subscription or connected vehicle services. If you select a new payment method for Energy Pass when you sign up to use Energy Pass, GM will also use that payment method for any recurring OnStar subscription payments you may have.
  • If you change your OnStar subscription payment method in the future, the new OnStar subscription payment method will be added to your saved payment methods in the Application and will be used as your designated payment method with Energy Pass.

 

Charging Feature Fees and Charges  

 

  • By charging your Vehicle at a Supported Network charging station, you agree to pay all applicable fees associated with that charging session, including but not limited to the following fees: energy fees, idle fees, and congestion fees. You may incur idle fees or congestion fees for the time your Vehicle remains parked in a charging stall or connected to a charging station after it is finished charging. Please ensure you review the Supported Network’s policies regarding applicable fees prior to charging at that Supported Network’s charging stations. 
  • You authorize us or our payment processor to charge the applicable fees (plus any applicable sales tax) to your designated payment method. We will place a temporary payment authorization hold on your payment method at the start of each charge session, and will release the authorization when your charge session is complete and successfully paid.
  • You will receive an email receipt after you complete charging.

 

Additional Terms for Energy Pass 

 

  1. You will only use Energy Pass for legitimate business or personal purposes, and not for resale. 
  2. We may suspend or terminate your use of Energy Pass at any time, with or without notice, if you do not comply with these Energy Pass Terms.
  3. We may remove or discontinue Energy Pass without further notice to you and without liability to you.
  4. We strongly advise you to use a GM NACS adapter for charging on the NACS public charging network, which adapters have been specifically designed to protect GM EV batteries while charging.  Damage to vehicle components resulting from the installation or use of non-GM approved parts is not covered under the terms of the vehicle warranty and may affect remaining warranty coverage for affected parts. 
  5. Except as set forth in the Energy Pass Terms, User Terms, or as required by applicable law, GM will not be liable for any damage or loss suffered as a result of your use of Energy Pass, a Supported Network charging station, or GM’s payment process.
  6. You acknowledge that GM may collect, use, disclose, and process information associated with your use of Energy Pass, in accordance with the General Motors U.S. Consumer Privacy Statement found at https://www.gm.com/privacy-statement.  
  7. Energy Pass may allow you to initiate charging sessions at participating public charging stations located in Canada. When you do so, you acknowledge and agree that: (a) General Motors Holdings LLC is not the provider of Energy Pass or any related charging services in Canada, and has no responsibility or liability in connection with charging sessions initiated outside the United States; (b) Energy Pass in Canada is provided by General Motors of Canada Company and is governed by the Energy Pass Terms (available at https://www.onstar.ca/en/legal/energy-pass-user-terms) and OnStar Privacy Statement (https://www.onstar.ca/en/legal/privacy-statement)  (the “Canadian Charging Terms”), which apply to your use of Energy Pass in Canada in place of these Energy Pass Terms; and (c) charging services in Canada are sold by the applicable Canadian charging network as merchant of record and are subject to that network’s own terms, policies, pricing, taxes, and dispute resolution procedures (collectively, the “Canadian Supported Network Charging Terms”). By initiating a charging session at a participating charging station located in Canada, you agree to be bound by the Canadian Charging Terms and the Canadian Supported Network Charging Terms, in each case as in effect at the time of the session, and acknowledge that your personal information will be processed in accordance with the OnStar Privacy Statement.  You are responsible for reviewing those terms before initiating a session in Canada. Currency conversion, foreign transaction fees, taxes, and other charges imposed by your payment method issuer or the Canadian charging network may apply, and General Motors Holdings LLC is not responsible for any such amounts.
